El Paso MS Community Individual & Family Release and Waiver of Liability

By signing this Individual & Family Release and Waiver of Liability (“Waiver”), and in consideration of participation in the Warrior Walk event organized by the El Paso MS Community (“Event”), I fully and completely waive and release the El Paso MS Community, its directors, officers, administrators, volunteers, agents, participants, sponsors, affiliates, and other related entities (collectively, the “Releasees”) from any and all claims, liabilities, damages, and/or causes of action arising out of any injury to me (or my dependent) or my property while participating in or attending the Event.

Acknowledgment of Risks

I understand and acknowledge that participating in Walk MS involves physical activity, including walking long distances, which carries certain inherent risks. These risks may include, but are not limited to:

  • Physical strain or overexertion.
  • Falls or collisions with participants, vehicles, or other objects.
  • Injuries ranging from minor to severe, including paralysis or death.
  • Adverse health effects related to food or beverages provided at the Event.

I also acknowledge potential risks related to environmental conditions such as weather (heat, rain, cold, etc.) and road surfaces (uneven or wet surfaces). I accept full responsibility for preparing and dressing appropriately, including wearing proper footwear and weather-appropriate clothing, to mitigate risks.

Medical Fitness and Emergency Care

I certify that I (or my dependent) am physically and medically able to participate in the Event. If I have any doubts about my (or my dependent’s) health or fitness to participate, I take full responsibility for consulting with a physician beforehand. In case of an emergency, I consent to any necessary medical treatment or transportation, and I release the Releasees from any liability arising from such medical care.

Assumption of Risk and Waiver

In consideration of being allowed to participate, I voluntarily agree to:

  1. Assume full responsibility for any risks associated with my (or my dependent’s) participation in the Event.
  2. Release and discharge the Releasees from all claims, actions, and liabilities arising from injury, illness, or property damage incurred during the Event, whether caused by negligence or otherwise.
  3. Refrain from bringing weapons of any kind to the Event or its associated activities.

Behavior and Compliance

I agree to follow all Event rules, instructions, and safety procedures. I understand that any inappropriate behavior may result in my (or my dependent’s) dismissal from the Event without refund.

Contagious Disease Acknowledgment

I acknowledge the potential exposure to contagious diseases, including COVID-19, as part of participation in the Event. I accept the associated risks, including the possibility of severe illness or death. I agree to adhere to all safety guidelines and refrain from attending if I am unwell or have been exposed to someone with symptoms of illness.

Photography and Media Release

I grant permission for the El Paso MS Community to use photographs, recordings, or other media of me (or my dependent) taken during the Event for promotional, educational, or commercial purposes, without compensation. I understand these materials may be used in print, digital, or other media platforms.

Parental Consent for Participants Under 18

If I am signing on behalf of a minor participant, I attest that I am their parent or legal guardian. I assume all risks and responsibilities associated with their participation and agree to accompany participants under the age of 14 throughout the Event.

Severability

If any part of this Waiver is deemed invalid, the remaining provisions will remain in full force and effect.

By signing this Waiver, I acknowledge that I have read, understood, and voluntarily agree to all terms. I am aware that this is a legally binding document and sign it of my own free will.
